New York 1099 tax FAQ
How much tax does an $80,000 freelancer pay in New York?
About $18,442 in NY state-only — 23.1% effective. NYC residents add another ~$1,500–$2,000 in city tax. Take-home for a state-only freelancer is roughly $55,558.
Does New York have a separate NYC city income tax?
Yes. NYC residents owe an additional 3.078% to 3.876% on NYC taxable income, on top of NY state tax. It's filed on Form IT-201 alongside your state return. Yonkers has its own smaller surtax. Suburbs and upstate pay state-only.
Does New York allow the federal QBI deduction?
No. New York does not conform to Section 199A. NY taxes your federal AGI before the QBI deduction, so high-income freelancers see a slightly higher state tax compared to a state that conforms.
Should New York freelancers pay quarterly estimated taxes?
Yes — both federally and to New York State. Federal Form 1040-ES and NY Form IT-2105 deadlines are April 15, June 15, September 15, and January 15. Pay federal via IRS Direct Pay; pay NY via the Department of Taxation & Finance online services portal.
What business expenses can NY freelancers deduct?
New York follows federal Schedule C deduction rules. Common deductions: home office, business mileage (70¢/mi for 2026), software, equipment, health-insurance premiums, retirement contributions, and professional services. Each $1,000 deducted typically saves $350–$500 in combined federal + NY state + NYC city tax.
Should a New York freelancer elect S-corp status?
Often yes above ~$80k net SE income — particularly for NYC residents. New York imposes a fixed-dollar minimum tax (Form CT-3-S) but the federal SE tax savings on the salary/distribution split typically net positive above this income. Run the numbers with a CPA before electing.
